Welcome to RareTCG.

These Terms of Service explain the terms that apply when you use our website, place an order through our online store or purchase products from RareTCG.

Please read these Terms carefully before placing an order.

In these Terms, the words RareTCG, we, us and our refer to HAWANA LTD trading as RareTCG.

The words you and your refer to the customer or website visitor.

2. Scope of These Terms

These Terms apply to:

  • your use of the RareTCG website;

  • orders placed through our online store;

  • local-collection orders placed through our online store;

  • purchases made directly from RareTCG where these Terms are provided or incorporated; and

  • communications and services connected with your order.

Our Shipping Policy, Refund & Returns Policy and Privacy Policy also apply where relevant and form part of these Terms.

Nothing in these Terms limits or excludes your statutory rights under applicable UK consumer law.

3. Our Products

RareTCG sells trading-card products and related collectables, which may include:

  • sealed trading-card products;

  • booster packs;

  • booster boxes;

  • collection boxes;

  • Elite Trainer Boxes;

  • tins;

  • trading-card singles;

  • graded cards;

  • accessories; and

  • other collectable products.

Product availability may change at any time.

Products shown as sold out cannot normally be purchased unless they are restocked and made available again through the website.

4. Product Information

We aim to provide clear and accurate descriptions, images and product information.

Please read the product page carefully before placing an order.

Product images are provided to help identify the product. Packaging artwork, promotional markings, language labels or minor presentation details may occasionally vary where manufacturers update packaging or release different production runs.

Where a listing is for an individual single card or graded card, the listing will indicate whether the product image shows the specific item being sold or is a representative image.

Minor differences that do not materially change the product will not normally amount to a defect. This does not affect your statutory rights where a product is faulty, damaged or not as described.

5. Collector Condition and Packaging

Trading-card products are condition-sensitive collectables.

Sealed products may occasionally have minor manufacturing, distribution or outer-packaging imperfections, such as light scuffing, small dents, slight corner wear or minor shrink-wrap imperfections.

If the external packaging condition is particularly important to you because you intend to keep a product sealed for display or collection purposes, contact us before ordering and we will advise where possible.

Singles and graded cards should be reviewed carefully using the information and photographs provided on the relevant product page.

Nothing in this section affects your statutory rights where an item is faulty, damaged or not as described.

6. Prices

Prices are displayed in pounds sterling (GBP) unless stated otherwise.

The price shown on the product page at the time you place your order is the price that normally applies to your purchase.

Applicable delivery charges will be shown during checkout before you complete your order.

Where taxes are applicable, they will be handled in accordance with the information shown at checkout and applicable law.

We may change product prices at any time before an order is placed.

A later change in the market value of a trading-card product does not change the agreed purchase price of an order that has already been accepted.

7. Pricing and Listing Errors

We take reasonable care when listing products and prices.

Occasionally, a genuine technical, typographical or administrative error may occur. For example, a product may be listed with an obviously incorrect price, incorrect stock status or materially incorrect description.

If we identify a significant error before accepting or dispatching your order, we may contact you to explain the issue and ask whether you wish to proceed on the correct terms.

Where appropriate, we may cancel the affected item or order and issue a refund.

We will not charge you an increased price without your agreement.

8. Placing an Order

To place an order, add the selected products to your cart and complete the checkout process.

Before submitting your order, please review:

  • the selected products;

  • quantities;

  • prices;

  • delivery details;

  • billing details;

  • delivery method; and

  • any applicable charges.

You are responsible for ensuring that the information you provide is accurate and complete.

After you place an order, you should receive an order-confirmation email acknowledging that we have received your order.

An automated acknowledgement does not always mean that we have accepted the order.

9. Order Acceptance

Your order is normally accepted when we confirm dispatch or confirm that your local-collection order is ready.

We may decline or cancel an order before acceptance where there is a legitimate reason, including:

  • a product is unavailable;

  • there is a genuine pricing or listing error;

  • payment cannot be authorised;

  • delivery cannot reasonably be completed to the address provided;

  • the order appears fraudulent or presents a genuine security risk;

  • the order breaches a purchase limit clearly stated on the product page;

  • the order breaches applicable law; or

  • circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been taken, we will issue an appropriate refund.

10. Stock Availability

We aim to keep product availability accurate.

However, stock levels may occasionally change before the website updates, particularly during busy product launches, sales or periods of high demand.

Adding an item to your cart does not reserve it.

A product is not secured until checkout has been completed and the order has been accepted.

If an ordered item becomes unavailable, we will contact you and provide an appropriate resolution. This may include cancelling the affected item and issuing a refund.

11. Purchase Limits

We may apply reasonable purchase limits to certain products, particularly where stock is limited or demand is unusually high.

Where a purchase limit applies, it should be shown on the product page or communicated clearly before checkout.

We may cancel quantities ordered in excess of a clearly stated purchase limit and refund the affected amount.

12. Payment

Available payment methods are shown during checkout.

Payment must be authorised before an order can be fulfilled.

Payments may be processed through Shopify, payment-service providers and financial institutions selected during checkout.

RareTCG does not normally receive or store your complete payment-card details.

If your payment is declined, reversed or flagged for review, your order may be delayed or cancelled.

13. Delivery

Delivery arrangements, charges and estimated timeframes are explained in our Shipping Policy.

Please provide a complete and accurate delivery address.

We are not responsible for delays caused by incorrect or incomplete information provided by the customer. However, we will try to assist where reasonably possible.

RareTCG remains responsible for your order until it has been delivered to you or to a person nominated by you.

14. Local Collection

Where available at checkout, you may choose to collect your order from our Liverpool trading location.

Please wait until we confirm that your order is ready before visiting.

When collecting an order, you may be asked to show your order-confirmation email and provide the name used for the order.

If another person will collect the order on your behalf, please contact us in advance.

15. Cancellation, Returns and Refunds

Your rights to cancel an online order, return eligible products and receive a refund are explained in our Refund & Returns Policy.

Nothing in these Terms or our Refund & Returns Policy limits or excludes your statutory rights.

Different rules may apply depending on whether:

  • you purchased online or in store;

  • you changed your mind;

  • the item is faulty;

  • the item is damaged;

  • the item is incorrect;

  • the item is not as described; or

  • the product has been handled beyond what is reasonably necessary to inspect it.

16. Promotions and Discount Codes

From time to time, we may offer promotions or discount codes.

Unless stated otherwise:

  • promotions are subject to availability;

  • discount codes must be entered during checkout;

  • only one discount code may be used per order;

  • discount codes cannot normally be exchanged for cash;

  • discount codes cannot normally be applied retrospectively;

  • promotional offers may have an expiry date;

  • promotional offers may apply only to selected products; and

  • promotional offers may be withdrawn or corrected where there is a genuine error.

Any specific terms shown with a promotion also apply.

17. Gift Cards

Where gift cards are available, additional terms shown at the time of purchase may apply.

Gift cards should be treated like cash and stored securely.

Please contact us promptly if you experience a problem using a RareTCG gift card.

18. Customer Accounts

You may be able to create a customer account.

You are responsible for:

  • providing accurate account information;

  • keeping login details secure;

  • not sharing account credentials with unauthorised persons; and

  • notifying us promptly if you believe your account has been accessed without permission.

We may suspend or restrict an account where reasonably necessary to protect customers, investigate misuse or prevent fraud.

19. Reviews, Messages and Other Content

Where you submit a product review, message, photograph or other content to RareTCG, you must ensure that it is lawful and does not infringe another person’s rights.

You must not submit content that is:

  • false or misleading;

  • abusive, threatening or discriminatory;

  • unlawful;

  • defamatory;

  • fraudulent;

  • infringing;

  • malicious;

  • unrelated spam; or

  • designed to interfere with the website.

Where appropriate, we may moderate or remove content that breaches these Terms.

20. Acceptable Use of the Website

You must not use the website:

  • for unlawful or fraudulent purposes;

  • to interfere with website security;

  • to introduce malicious code;

  • to gain unauthorised access to systems or data;

  • to scrape, copy or extract data in a way that materially disrupts the website;

  • to impersonate another person;

  • to submit false payment or delivery information; or

  • to place orders that you do not genuinely intend to pay for.

We may take reasonable steps to protect the website, customers and our business from misuse.

The RareTCG website and its original content may include:

  • branding;

  • graphics;

  • photographs;

  • product-page content;

  • design elements; and

  • software-related materials.

These materials may be owned by RareTCG, licensed to us or used with permission.

You may use the website for personal shopping and informational purposes.

You must not reproduce, republish, commercially exploit or distribute our original materials without permission, except where the law allows.

Third-party names, trademarks, product images and intellectual-property rights remain the property of their respective owners.

  • delivery providers;

We are not responsible for losses that are not reasonably foreseeable.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • fraud or fraudulent misrepresentation; or

  • any statutory consumer right that cannot lawfully be excluded or restricted.

If you purchase products wholly or mainly for business purposes, different rules may apply to business-related losses.

We are not responsible for delays or failures caused by events outside our reasonable control.

Examples may include:

  • severe weather;

  • carrier disruption;

  • strikes;

  • transport disruption;

  • major service outages;

  • cyber incidents;

  • natural disasters;

  • government action;

  • emergencies; and

  • other events that could not reasonably have been prevented.

Where an event affects your order, we will take reasonable steps to contact you and provide an appropriate resolution.

Nothing in this section removes any statutory rights you may have.

28. If Part of These Terms Is Invalid

If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining sections will continue to apply.

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you may also have the benefit of mandatory protections and the right to bring proceedings in the courts available to you under applicable law.

Nothing in this section limits any rights you may have under applicable consumer law.
